"GUNNS20" HEARING TODAY

A Hearing has been set down by Justice Bongiorno for today in the matter of Gunns Ltd & others v Marr & others (the 'Gunns20') in the Victorian Supreme Court.

Various Defendants will be seeking parts of the statement of claim to be struck out at this hearing.

Last Friday, the plaintiffs served an amended statement of claim, which has nearly doubled the length of the document from 216 pages to 360 pages.

Arguments are anticipated over whether the amended statement of claim can be filed at this stage of the proceedings. The amended statement of claim may have implications for defences already filed and defendants' legal advice and costs incurred to date responding to the earlier edition.

Peg Putt, MHA (the eleventh Defendant in the proceedings), a representative for The Wilderness Society (the sixth defendant) and Counsel for various other defendants will be available for comment following the hearing.
