Amended Statement of Claim re: Frank Nicklason. 1 October 2007

After the case was discontinued against Dr Nicklason on 3 April 2007 Gunns immediately issued fresh proceedings against Dr Nicklason alone. The new proceedings seek unspecified damages for defamation on the basis of alleged comments that Dr Nicklason made to a journalist on 8 April 2002. The new proceedings do not allege Dr Nicklason was part of a grand conspiracy to injure Gunns as was alleged in the first three statements of claim. Gunns Deliver Two New Statements of Claim. 3 April 2007

Following the decision of Justice Bongiorno on 3 April 2007 in the Victorian Supreme Court, Gunns delivered two new statements of claim to the remaining defendants.

The first concerns five of the original ten actions in the previous claim and involves 14 of the 20 defendants. The second is against Dr Frank Nicklason only for defamation and relates to alleged comments he made to the media about a woodchip pile in Burnie.

Three New Proposed Statements of Claim submitted by Gunns

Around 4pm on Friday 17 November 2006, Clayton Utz (solicitors for Gunns) served two documents, which included three proposed statements of claim. The documents also request that there be three separate trials. Late on the 13th December they confirmed that Gunns will not be proceeding with actions against Bob Brown, Peg Put, Helen Gee, Peter Pullinger or Doctors for Native Forests. Claims remain against the Wilderness Society and the other defendants.

It was provided to defendants in August 2005 after Judge Bongiorno struck out versions 1 and 2. In March 2006 this document was amended by order of the Judge to correct certain errors it contained.
