Gunns application to lift the stay on the case was heard today. The stay was placed on the case by Justice Bongiorno in August 2006. Gunns had previously submitted the fourth version of their statement of claim after the first three were thrown out by the court. At this hearing they argued they should be allowed to serve the claim on the defendants. There was also argument about the manner in which five of the defendants would exit the case and the costs consequences to Gunns.
