Gunns Serve Fifth Version of Claim. 28 August 2009

On 28 August 2009, Gunns, through lawyers Clayton Utz, served the fifth version of their claim in the Gunns20 case.

This actually involves two claims, one by Gunns Ltd and one by two of Gunns' subsidiaries (Tasmanian Pulp and Paper and Gunns Forest Products). The subsidiaries sued the remaining Gunns20 defendants in January 2009. The basis for the claim is essentially the same as the current version of the original Gunns20 case.

The changes in the fifth version of the claim include:

1)Adam Burling and Lu Geraghty being dropped from the Hampshire action. The Hampshire action concerns allegations that defendant Louise Morris and others locked-on to a crane at Gunns' Hampshire woodchip mill.

2)Louise Morris being dropped from the Lucaston action. The Lucaston action is alleged to have occurred over two years and involved various protest activities by defendants and others in the rural residential locality of Lucaston.

The decision to drop these claims may result in Gunns being ordered to pay Morris, Burling and Geraghty's legal costs in relation to them.

The two new statements of claim have been filed in court and are attached.
